Professional Liability

Moran Kidd’s professional liability practice represents attorneys, accountants and other professionals throughout the State of Florida.  The firm provides risk management guidance, consultations on professional ethics and standards and defends its clients in both administrative and civil litigation proceedings.  The goal of the professional liability practice group is to develop an early understanding of the facts, issues and potential exposure presented and identify strategies and defenses to best achieve desired outcomes.  Throughout the process, Moran Kidd’s attorneys, paralegals and legal assistants value communication with their clients to ensure a supportive and collaborative environment exists throughout the process.

With respect to administrative actions, Moran Kidd’s attorneys have experience with a variety of professional licensing issues with particular emphasis on Florida Bar and Board of Accountancy/Department of Business and Professional Regulation Proceedings.  The practice group has also handled matters before the Federal Elections Commission, the United States Congress Committee on Ethics, the American Institute of Certified Public Accountants and Executive Office for Immigration Review.  On the civil side, the practice group is frequently engaged to respond to pre-litigation demands, state and federal lawsuits, third-party/counter/cross claims, assignment claims and adversary proceedings.  The practice group’s goal is to evaluate and resolve matters quickly, but they are fully prepared to take professional liability cases to trial in both state and federal courts if needed.  A number of the firm’s professional liability cases are handled in the jurisdiction’s business court or involve complex litigation guidelines.  Many of these cases involve multi-layered and complex liability and damages issues and the firm frequently uses well known legal experts and forensic accountants to evaluate and analyze the issues and damages asserted.

In terms of day-to-day operations, the professional liability practice group utilizes internal and external processes to assemble, analyze and produce large volumes of electronically stored information and has significant experience with large volume document management.  To that end, the group frequently assists its clients in complying with subpoenas from the Department of Justice, Securities and Exchange Commission, Internal Revenue Service, Office of Inspector General and various state and local agencies who direct and conduct investigative proceedings.  The firm also acts as a liaison to professionals who are called to testify before grand jury proceedings or as witnesses in civil and criminal trials with the goal of demystifying the process and making sure the professionals’ time and efforts are appropriately considered.  There is a huge emphasis on personal service and taking the stress out of amazingly stressful situations.
